There Is No Legal Requirement for Hiring Clients to Review Vendor H&S Programs
Under Canadian occupational health and safety legislation, with limited and specific exceptions, responsibility for Health & Safety policies and programs rests with the vendor as the employer of record — not the hiring client. Assuming oversight where the law does not require it can unintentionally increase risk rather than reduce it.
Hiring clients typically:
- do not supervise vendor workers,
- do not control how tasks are performed,
- do not manage day-to-day safety behaviour.
Yet OH&S-centric vendor programs often create a paper trail that implies oversight without providing operational control.
Routine collection or validation of vendor H&S programs by a property owner or manager can unintentionally expand duty of care, create implied oversight, undermine contractual and insurance-based risk transfer, and increase exposure following an incident.
